My Criminal Defense Practice

I handle the defense of all adult and juvenile crimes under the Texas criminal laws, including

Driving While Intoxicated (DWI). In Texas, you will be arrested and charged with driving under the influence (DUI) if your blood alcohol level is .08 or higher. You can also be charged with driving while intoxicate if you are visibly impaired, even if your BAC is below .08. In addition to fines or jail time for the criminal offense, you can also face automatic suspension or revocation of your drivers license. I will represent you in both proceedings.

Homicide Offenses. Texas has four types of homicide, all of which are felonies. Murder and capital murder charges require intent, whereas manslaughter requires only a showing of recklessness. A charge of first-degree murder can be reduced by showing that the homicide was committed as the result of a sudden and irresistible impulse. You can also be charged with criminally negligent homicide. At my offices, I will work closely with you to identify any defenses or argue for a reduction in the degree of the offense.

Drug Crimes

I handle the defense of all state and federal drug offenses in Texas, including

  • Possession of illegal drugs (including marijuana and prescription drugs)
  • Possession with intent to deliver or possession with intent to distribute
  • Sale or trafficking of controlled substances
  • Manufacture or cultivation of illegal drugs
  • Possession of a firearm during a drug trafficking offense
  • Maintaining a house where drugs are kept or sold

I will also defend you if you have been charged with facilitating a drug transaction by a communication device or with money laundering related to the purchase or sale of controlled substances.

Passing Bad Checks ("Hot Checks")

In Texas, it is a criminal offense to write and submit a check if you have no bank account or if the check is refused and you fail to make good on the check within 10 days. You can be charged with a misdemeanor, but can often avoid conviction by making restitution. If you have been charged with passing a bad check, I can help you minimize the consequences.

Assault and Battery

A charge of assault and battery is actually a combination of two serious charges. Assault is the threat of imminent physical harm, whereas battery occurs when the perpetrator touches the victim. Assault is generally a misdemeanor, but may rise to the level of a felony if it can be shown that it was aggravated. This can be shown if the defendant used a firearm, if the assault caused serious bodily injury, or if the assault is against a witness, informant or government employee.

In addition to the above, I will also assist you with charges related to theft, burglary, harassment, arson and weapons violations. I will aggressively advocate to ensure that your constitutional rights are protected, that your arrest was proper, and that the evidence against you is admissible.
