My Family Law PracticeIn my family law practice, I work with clients throughout the divorce process, from the decision to file through requests for enforcement or modification of existing custody, visitation and alimony orders. I handle most matters related to or arising out of a divorce, including - Child custody and visitation. In Texas, custody and visitation arrangements must place a priority on the best interests of the children. This includes a consideration of the health and educational needs of the child, as well as the distance between parental homes and, when the child reaches a certain age, the wishes of the child. I will help you establish custody and visitation arrangements that promote the best interests of your child while protecting your rights as a parent.
- Property division. Texas applies the concept of equitable distribution, where the division of marital assets is equitable, but not necessarily equal. The court may consider a number of factors, including, but not limited to,
- The earning potential of the parties
- The age and health of the parties
- Fault in the break-up of the marriage
- The length of the marriage
- The responsibility for caring for minor children
I will work closely with you to structure a property settlement that fairly divides all marital assets, including real property, investments, retirement funds and business assets. - Temporary alimony or spousal maintenance. Temporary alimony is not automatically granted in Texas divorce cases. The court will make its determination based on a number of factors, including the length of the marriage, the financial resources of both parties, the potential earning capacity of the parties and the age and health of the parties. I will help you determine whether a grant of temporary alimony is warranted and, if so, the appropriate amount, frequency and duration of payments.
- Modification of existing orders. If your circumstances have changed after a divorce decree has been finalized, you may be able to obtain a modification of existing custody, visitation, and support orders. If you have moved or lost your job, or if your child has health or educational needs that warrant a change, I can help you seek the necessary changes.
